General terms and conditions of business

 

1. General terms, scope of application

Life Transformation Coaching & Counselling Sylvia F. Rodatz ( in the following referred to as Coach), conducts coaching, workshops and other events according to these General Terms and Conditions (GTC). With the assignment, these terms and conditions are considered accepted by the contracting party (hereinafter referred to as client). Deviations from these terms and conditions must be agreed upon in writing. Deviating terms and conditions of the client shall not apply unless expressly agreed in writing.

 

2. Conclusion of contract

A contract is considered to be concluded when the client places an order and the coach accepts the order. The placement of the order by the client and the acceptance of the order by the coach can take place by e-mail, telephone, in writing or verbally.

 

3. Differentiation from psychotherapy

Life Transformation Coaching and psychological counseling is not psychotherapy and does not replace it. Coaching is based on a partnership between coach and client, in which the role of the coach is clearly differentiated from the role of therapist and doctor. Psychotherapy is the targeted treatment of a mental illness. Coaching serves the "healthy" person, who is capable of acting and self-reflection. The result of a coaching session is not the reduction of psychological complaints, but the individual development of the client, which is accompanied by an increase in his or her general quality of life. 

Every client is responsible for him or herself before, during and after the coaching. 

By placing an order, the client confirms that he/she feels mentally and physically healthy and can participate in the coaching. 

By placing an order, the client also expressly declares that he/she has read and agreed to the terms and conditions.

 

4. Appointment and registration

The date of a coaching session and the coaching location will be mutually agreed upon by coach and client. 

Registration for workshops and other events is only possible in writing, by e-mail or by using the respective booking form.

 

5. Offers, fees, terms of payment

The offers are subject to change without notice, subject to modifications.

All offers are charged at the fees published on the website and/or stated in the event announcement.

All prices are quoted in EURO. The prices quoted are net prices, VAT may be payable. Value-added tax is not applicable for cross-border transactions.

Unless otherwise agreed, invoices are payable immediately without deduction. In case of delay in payment, the further execution of the current contract can be suspended until full payment of the entire order.

Registrations for workshops will be processed in the order in which they are received. The fees for workshops and other events are due at the latest four weeks before the date of the event. The client will receive a confirmation of registration and an invoice to transfer the amount in due time.

 

6. Cancellation of a coaching appointment or event by the client

A cancellation or postponement of a coaching appointment is possible free of charge up to 24 hours before the appointment at the latest. In case of a later cancellation or postponement of an appointment as well as in case of no-show, the fee for the agreed time will be charged in full.

Cancellation of workshops and booked events is possible up to four weeks before the start. In case of a later cancellation, 50 % of the event fee will be charged as cancellation costs. In case of no-show the full fee for the event will be charged.

 

7. Cancellation of a coaching appointment or event by the coach

The coach has the right to break off the cooperation at any time or to cancel coaching sessions for important reasons - such as illness of the coach or higher force. In this case, only the coaching hours performed will be invoiced. Further claims, especially compensation claims are excluded.

In the event that the required number of participants for an event is not reached or an event has to be cancelled for other reasons, the client will be informed as soon as possible and will be refunded the participation fee already paid. No further claims exist beyond this.

 

8. Data protection

The participant agrees that personal data may be stored and processed within the scope of the contractual relationship. All personal data will of course be treated confidentially and in accordance with the EU General Data Protection Regulation (GDPR).

 

9. Liability

The coach commits him/herself to organize all coaching sessions, workshops etc. in accordance with his/her professional and expert knowledge and the coaching ethics. There is no guarantee for success of the coaching or the events. Any liability is excluded.

By making an appointment or registering for events, the client confirms that he/she acts on his/her own responsibility and releases the coach from all liability claims. 

The client acknowledges that he/she is fully responsible for his/her physical and mental health and that he/she is responsible for any damages caused, unless the coach is grossly negligent.

 

10. Confidentiality

The Coach undertakes to maintain confidentiality about all professional, business and private matters of the Client that have become known in the context of the activity, even after the termination of the contract.

 

11. Place of performance, choice of law 

Unless otherwise stated in the contract, the place of performance and payment is the business location of the Coach.

The law of the Netherlands applies to this agreement.

 

12. Salvatory clause

Any invalidity of one or more terms of these GTC shall not affect the validity of the remaining terms. In place of the ineffective regulation, a replacement regulation which corresponds or comes close to the sense and purpose of the contract shall apply, which the parties would have agreed upon to achieve the same economic result if they had known the ineffectiveness of the regulation.
